Applying for Settlement (Indefinite Leave to Remain) as a Refugee or Person with Humanitarian Protection

After completing five continuous years in the UK with refugee status or humanitarian protection, you have the opportunity to apply for Settlement, also known as Indefinite Leave to Remain (ILR).

Securing ILR means you will no longer be subject to immigration time restrictions. You will have the permanent right to live, work, and study in the UK, continue accessing public funds, and eventually apply for British citizenship.

However, settlement is not granted automatically. The Home Office carefully reviews each application to ensure you still require protection and meet strict suitability requirements. Below is a comprehensive guide to the eligibility criteria, the application process, and how our immigration specialists can assist you.

1. Core Eligibility Requirements

To qualify for Settlement on the protection route, you must demonstrate to UK Visas and Immigration (UKVI) that you:

  • Have Completed 5 Years: You have lived continuously in the UK for five years with either valid refugee status or humanitarian protection.

  • Hold Valid Status: Your protection status has not been revoked or renounced.

  • Apply at the Right Time: You must apply during the last month of your current permission to be in the UK. Applying too early may result in an automatic refusal.

  • Are in the UK: You must be physically present in the UK on the date you submit your application.

2. The "Safe Return Review"

Before granting settlement, the Home Office conducts a "Safe Return Review" to assess whether you still need the UK's protection. Your application could be refused, and your protection status potentially revoked, if there is evidence that:

  • Country Conditions Have Improved: There has been a significant and non-temporary change in your home country, meaning the reasons you became a refugee have ceased to exist.

  • Personal Circumstances Have Changed: Your individual situation has changed such that you can now return safely.

  • You Re-availed Protection: You applied for or renewed a national passport from your home country.

  • You Travelled Back: You have returned to your country of origin since being granted protection in the UK.

3. Criminality and Suitability Rules

The Home Office applies strict suitability criteria. You will be refused settlement if you have a serious criminal history or represent a threat to national security.

For example, your settlement application will be refused if you have been sentenced to 4 years or more in prison. For lesser sentences, specific waiting periods apply (e.g., 15 years from the end of a sentence of 12 months to 4 years) before you can qualify for ILR.

Note: If you are refused settlement purely on criminality grounds but still need protection, you will typically be granted a further 30-month extension of your refugee status instead of permanent ILR.

4. Dependants and Family Members

If your partner or children were granted permission to stay in the UK in line with your protection status, they can often be included in your settlement application.

  • Partners: Must show the relationship is genuine, subsisting, and that you intend to continue living together. Any previous relationships must have broken down.

  • Children: Must be under 18, not married or in a civil partnership, and living with you.

If your family members are not eligible to be included on your main application, they will need to submit separate applications based on their specific circumstances.

5. The Application Process

Unlike many other UK visa routes, there is no Home Office fee to apply for settlement under the refugee or humanitarian protection route.

  1. Apply Online: Applications must be submitted online through the official government application portal.

  2. Provide Biometrics: After submitting the form, you must prove your identity. You will be told to either use the 'UK Immigration: ID Check' app to scan your documents, or book an appointment to provide your fingerprints and a photograph at a UK Visa and Citizenship Application Services (UKVCAS) centre.

  3. Upload Documents: You must provide your current Biometric Residence Permit (BRP) or travel document, proof of continuous residence, and evidence of your relationships if applying with family.

6. Processing Times and Section 3C Leave

The Home Office typically makes a decision within six months of you submitting your application and biometrics.

If you apply before your current permission expires, your existing leave will be automatically extended under Section 3C of the Immigration Act 1971 while you await a decision. This means your right to work, rent property, and access public funds remains fully protected during the processing period. You should not travel outside the UK while the application is pending.
